MEMPHIS – Special Agents with the Tennessee Bureau of Investigation have arrested a Tipton County man and juvenile and charged each with the attempted murder of an officer.

At the request of 25th District Attorney General Mike Dunavant, Special Agents with the TBI began investigating an officer-involved shooting at Highway 51 and McLaughlin Road in Munford on December 13th. During the course of the investigation, agents learned that Tipton County Deputy Demario Avery was in an unmarked car at the intersection when he observed a man fire shots into a car stopped in front of him. Da’Cavius Fayne, an occupant of the car, returned fire with the gunman. When the deputy announced himself as a police officer, Fayne turned his weapon toward the officer and Deputy Avery shot Fayne, striking him in the leg. Montavo Terry, the other occupant of the car, then aimed his weapon at the officer. Deputy Avery fired at Terry but did not strike him. Fayne and Terry fled the scene on foot but were later apprehended.

Montavo Terry, 19, was arrested Sunday and booked in the Tipton County Jail on a $250,000 bond. Da’Cavius Fayne, 17, was booked Wednesday and is being held in juvenile detention in Shelby County. Terry (left below) and Fayne (right below) are each charged with Attempted Second Degree Murder, Possession of a Firearm During the Commission of a Dangerous Felony and Reckless Endangerment.
